Amanita Muscaria is Classified as a Dietary Supplement by the FDA
Amanita Muscaria is not specifically listed on the Controlled Substances Act (CSA). Without any kind of designation as a Schedule I-IV substance, this mushroom is largely unregulated at the federal level. However, the Food and Drug Administration (FDA) holds regulations on any food, drug, or cosmetic sold across state lines. The FDA currently classifies Amanita Muscaria as a dietary supplement and holds it to the same standard as any other supplement covered under the Dietary Supplement Health and Education Act of 1994.

What is Amanita Muscaria?
Amanita Muscaria can grow up to 12 inches, characterized by a white-dotted red cap that can be up to eight inches in diameter. They prefer to grow in temperate forests in the Northern Hemisphere through late summer into fall. Tribes across Siberia, Scandinavia, and Russia are documented using Amanita Muscaria through the centuries for its analgesic, anti-inflammatory, anxiolytic, and psychoactive properties. Today, it is consumed for many of the same reasons.
The effects of the Amanita Muscaria are reported to be an elated psychoactive experience that releases the mind from worry. It is often described as mild clear-headed euphoria that can be creative and introspective. Research has shown that Amanita Muscaria can alleviate stress, improve sleep, and reduce neuropathic pain.
Federal Regulations for Amanita Muscaria
According to the Dietary Supplement Health and Education Act, vitamins, minerals, herbs, and other botanicals can be sold without FDA approval. However, these companies are not allowed to market products that are adulterated and misbranded. Manufacturers are responsible for evaluating the safety and labeling of their products. None of these products are allowed to make claims to treat, diagnose, cure, or alleviate diseases or their effects. The labeling is only allowed to outline the “intended structure” of the human body it affects.
Every label must also boldly state, “This statement has not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.” All Amanita Muscaria products must also be in compliance with Current Good Manufacturing Practice (cGMP). If any of these products violate these regulations, the FDA has the authority to take action after a product has reached the market.

State Regulation for Amanita Muscaria
Amanita Muscaria has largely been unregulated at the state level. This is because it is not on the federal CSA. The only state to take any action against this mushroom is the state of Louisiana. Under Louisiana State Act 159, it is illegal to grow, sell, or possess Amanita Muscaria unless it is used strictly for decorative purposes.
As these mushrooms gain popularity, state governments may decide to schedule them while others might decide to impose an outright ban. Before purchasing any online, it is important to check local laws to ensure legality.
